Consent to the processing of personal data

By submitting a contact form on affario.com (affario.ru) or by reaching out through the contacts published on the Website, I, as a data subject (the Data Subject), freely, of my own will and in my own interest, give my consent to Individual Entrepreneur Ilham Fatykhovich Khabibullov, TIN 564101695894, PSRNIE 325565800099402, address: 38 Kazanskaya St., Nauruzovo, Ponomaryovsky District, Orenburg Region, 461790, Russia, email for enquiries: info@affario.ru (the Operator), to process my personal data on the terms set out below.

1. Personal data covered by this consent

• name (where provided);
• email address, phone number or messenger handle — depending on which contact is entered in the form;
• the service of interest (where selected in the form on the Contacts page);
• the text of the enquiry and any information included in it on my own initiative;
• the date and time of the submission and the section of the Website it was sent from;
• the content of subsequent correspondence and talks with the Operator;
• position and role — for persons acting on behalf of a company or an entrepreneur;
• records of the consents given and the dates they changed.

Bank card details and other payment data are neither requested nor stored by the Operator: the Website accepts no payments.

2. Purposes of processing

The consent is given for the following purposes:

• receiving and reviewing the enquiry, preparing and sending a reply;
• contacting me by email, phone and messengers about my enquiry;
• clarifying the task, preparing a commercial proposal and entering into a service agreement;
• performing the agreement and supporting the project after launch;
• producing mandatory accounting and tax documents as required by the legislation of the Russian Federation;
• keeping the Website secure and preventing automated form submissions.

Consent to receive marketing messages is not part of this consent and is given separately.

3. Operations performed on personal data

The consent covers any operation on the personal data listed in section 1 that is provided for by Article 3 of 152-FZ, including: collection, recording, systematisation, accumulation, storage, updating (refreshing, amending), retrieval, use, transfer to third parties in the manner and within the limits set by the Operator’s Privacy Policy, anonymisation, blocking, deletion and destruction.

Processing is carried out both with and without automation tools.

4. Transfer of personal data to third parties

The Data Subject consents to the transfer of their personal data to the following categories of third parties for the purposes set out in section 2:

• hosting provider Beget LLC (TIN 7813348421) — to host the Website’s server infrastructure and deliver email notifications;
• YANDEX LLC (TIN 7736207543) — with respect to the anonymised visit data collected on affario.ru by the Yandex.Metrica service;
• specialists and contractors engaged by the Operator to perform an agreement — to the extent needed to carry out the work;
• public authorities upon their request in the manner prescribed by law.

5. Term of the consent

5.1. This consent is effective from the moment it is given until the Data Subject withdraws it in one of the ways described in section 6.

5.2. If no withdrawal is received, processing ends once the retention period for the relevant category of data set out in section 9 of the Privacy Policy expires (three years for enquiries submitted through the forms).

5.3. Once consent is withdrawn, the Operator stops processing, except where processing continues on another legal ground that does not require the Data Subject’s consent (obligations under Federal Law No. 402-FZ “On Accounting”, Article 23 of the Tax Code of the Russian Federation and other duties expressly imposed by law).

6. How to withdraw the consent

6.1. The consent may be withdrawn at any time in one of the following ways:

• by sending a notice to info@affario.ru with the subject “Withdrawal of consent to the processing of personal data”, stating the name and the contact used when the form was submitted;
• by sending a written notice by registered mail with acknowledgement of receipt to: IE I.F. Khabibullov, 38 Kazanskaya St., Nauruzovo, Ponomaryovsky District, Orenburg Region, 461790, Russia.

6.2. Processing stops within 30 (thirty) calendar days of the withdrawal notice being received.

7. Miscellaneous

7.1. This consent is a standalone document and is given by a separate checkbox when a contact form is submitted, separately from the acceptance of the Terms of Use.

7.2. Consent to receive marketing messages about the Operator’s services is a standalone consent, is given separately and may be withdrawn independently of this one.

7.3. Detailed information on how the Operator processes personal data, on retention periods, security measures and the rights of the Data Subject is set out in the Privacy Policy.

7.4. The Data Subject confirms that the personal data provided is their own. Where an enquiry contains data of third parties, the Data Subject confirms that their consent to the transfer and processing has been obtained.
